Dave has regularly appeared before various township, village, municipal and county zoning and land use boards and commissions over the past 20 years.  While the primary emphasis of Dave's practice has been single-family residential development, he also represents clients in various commercial, industrial and mixed-use real estate matters.  Dave represents clients regarding formations and general business matters, and is an experienced trial attorney.  He has represented clients in personal and business litigation, and in land use litigation against Ohio township zoning authorities.  Dave has experience before State licensing and regulatory bodies, including the Ohio Real Estate Commission, and has experience in the establishment of federal trade zones.  For seven years, Dave served on the Planning Commission for Grove City (5 years as its chairman) and at the same time was the President of the Grove City Area Community Improvement Corporation, a quasi-governmental agency formed pursuant to statute to promote commercial and industrial development in the region. 

 

Dave continues to represent Central Ohio builder-developers in their acquisition, financing, zoning, construction and sale of single-family, multi-family, condominium and commercial development sites.  Dave also owns and operates a company that manages homeowners' associations collectively representing approximately 18,000 single-family residential lots in Central Ohio.

Experienced in structuring of conventional and non-conventional acquisition and development financing, including governmental participatory (tax increment financing, bond-based financing, community tax districts), private placement and/or investment lending, borrowing within requirements of Islamic laws, seller financing, 1031 tax-deferred exchanges

Appears before numerous zoning and land use boards and commissions

Advises developers on site planning and development issues, including but not limited to drafting deed restrictions and conducting turnover meetings to transition association control from developers to resident property owners

Significant experience drafting general and specialized deed restrictions for single-family developments, and condominium documents for residential and commercial condominium developments

Counsels and advises boards of trustees for homeowner associations

Handles formations of non-profit corporations, including but not limited to homeowner associations

Owns and operates homeowner association management company overseeing the daily operations of subdivisions collectively consisting of over eighteen thousand residential lots in Central Ohio

Significant experience in representing litigants in real estate and corporate litigation matters; jury trial experience in both State and Federal Courts

Appellate representation in State and Federal Courts

Significant experience in Small Claims Court collections actions
